The UK Governmenthas failed in its attempt to overturn a landmark ruling which found thatfit-for-work benefits tests are unfair for people with mental health problems.
The Court of Appeal has ruled that two people with a mentalillness can continue their legal challenge against government tests forsickness benefit.
Paul Farmer, CEO of mental health charity Rethink, said:”This is a really importantbreakthrough. It means that a court case which could force the Government tomake vital changes to the benefits system has cleared an important hurdle. Itmeans we are one step closer to creating a fairer benefits system.”
